3.1 Service Availability

• The Platform is provided on an "as available" basis and may experience interruptions, delays, or errors
• We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice
• Scheduled maintenance windows may temporarily affect Platform availability
• We do not guarantee uninterrupted, secure, or error-free operation of the Platform

3.2 Software Updates

• The Platform may undergo updates, enhancements, or modifications without prior notice
• Features may be added, modified, or removed as we improve our Services
• AI models and algorithms are continuously updated to improve accuracy

3.3 Technical Issues

• While we strive for technical excellence, bugs or errors may occur
• Please report issues to support@getonglobal.com
• We are not liable for damages arising from technical issues or service interruptions

4. Eligibility and User Requirements

4.1 General Eligibility

• You must be at least 18 years of age to use the Platform
• You must have the legal capacity to enter into binding agreements under applicable Indian law
• You must not be prohibited from using the Platform under applicable laws
• You must provide accurate, current, and complete information during registration

4.2 Candidate Requirements

• Must be legally authorized to work in the jurisdictions where seeking employment
• Must provide truthful and accurate information in profiles, resumes, and applications
• Must not create multiple accounts or misrepresent identity

4.3 Employer Requirements

• Must be a legitimate business entity or authorized representative
• Must comply with all applicable employment and anti-discrimination laws
• Must provide accurate job descriptions and company information
• Must not post fraudulent or misleading job opportunities

5. User Account Responsibilities

5.1 Account Security

• You are solely responsible for maintaining the confidentiality of your account credentials
• Notify us immediately at security@getonglobal.com of any unauthorized access
• You are liable for all activities that occur under your account
• Use strong passwords and enable two-factor authentication when available

5.2 Prohibited Activities

Users shall not:

• Use the Platform for any unlawful, fraudulent, or malicious purposes
• Attempt to circumvent or manipulate our AI systems or security measures
• Harvest, scrape, or collect user data without authorization
• Create fake profiles or impersonate others
• Post spam, malware, or inappropriate material
• Harass, abuse, or discriminate against other users

6. Employer-Specific Responsibilities

6.1 Legal Compliance

• Anti-Discrimination: Comply with all equal employment opportunity laws
• Labor Laws: Adhere to minimum wage requirements and working hour regulations
• Privacy Laws: Handle candidate data in compliance with DPDP Act, 2023 and IT Act, 2000
• Sexual Harassment: Comply with the Sexual Harassment of Women at Workplace Act, 2013

6.2 Job Posting Standards

• Job descriptions must be accurate, complete, and not misleading
• Compensation information must be truthful
• Must not include discriminatory criteria based on protected characteristics
• Must treat all candidates fairly and professionally

7. AI-Based Services and Disclaimers

7.1 AI Assistance Limitations

• Our AI systems provide recommendations, scores, and insights, NOT final hiring decisions
• Employers retain full and sole responsibility for all hiring decisions
• AI assessments should be considered alongside human judgment
• We do not guarantee the accuracy or reliability of AI-generated insights

7.2 No Employment Guarantees

• We do not guarantee job placement for candidates
• We do not guarantee successful hires for employers
• Platform usage does not create an employment relationship with Levitation Infotech LLP

8. Fees, Subscriptions, and Payments

8.1 Service Tiers

• Free Tier: Basic access with limited features
• Premium Subscriptions: Enhanced features, priority support, advanced analytics
• Enterprise Plans: Custom solutions with dedicated support and SLAs

8.2 Payment Terms

• Fees are billed in advance on a monthly or annual basis
• All fees displayed in Indian Rupees (INR) or US Dollars (USD)
• All fees are exclusive of applicable taxes including GST
• Price changes require 30 days' advance notice

Refund requests are governed by our Refund Policy.

9. Cancellation and Termination

9.1 User-Initiated Termination

• Cancel your account at any time through account settings or by contacting support
• Cancellation takes effect at the end of the current billing period
• No refunds for unused portions of paid subscriptions

9.2 Company-Initiated Termination

• We may suspend or terminate accounts for violations of these Terms
• Termination may be immediate for serious violations or security threats
• We reserve the right to refuse service to anyone for any lawful reason

10. Intellectual Property Rights

10.1 Company's Intellectual Property

• Levitation Infotech LLP owns all rights to the Platform, software, algorithms, and AI models
• "Get on Global" and our logos are trademarks of Levitation Infotech LLP
• All Platform content is protected under the Copyright Act, 1957

10.2 User Content

• Candidates retain ownership of their resumes and personal information
• Employers retain ownership of job descriptions and company information
• Users grant us a license to use their content for Platform operations

11. Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEVITATION INFOTECH LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) INR 5,000.

12. Indemnification

You agree to indemnify, defend, and hold harmless Levitation Infotech LLP from any claims, damages, or expenses arising from:

• Your use or misuse of the Platform or violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations
• Any content you submit through the Platform
• Your hiring decisions or employment practices (for Employers)

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, Information Technology Act, 2000, and Consumer Protection Act, 2019.

13.2 Dispute Resolution

1. Informal Resolution: Contact us at legal@getonglobal.com to seek informal resolution within 30 days.
2. Mediation: If informal resolution fails, disputes shall be referred to mediation under the Mediation Act, 2023.
3. Arbitration: Remaining disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat in Noida, Uttar Pradesh.

14. Compliance with Indian Laws

14.1 Information Technology Act, 2000

• We operate as an "intermediary" under Section 2(1)(w) of the IT Act
• We comply with the IT (Intermediary Guidelines) Rules, 2021

14.2 Digital Personal Data Protection Act, 2023

Personal data is processed in accordance with the DPDP Act, 2023. Our Privacy Policy details our data processing practices.

14.3 Consumer Protection

Nothing in these Terms shall prejudice your rights under the Consumer Protection Act, 2019.

15. Updates to Terms and Conditions

We reserve the right to modify these Terms at any time. We will provide notice of material changes through:

• Email notification to registered users
• Prominent notice on the Platform
• Updates to the "Last Updated" date

Material changes will take effect 30 days after notice. Continued use constitutes acceptance.

16. Miscellaneous Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement.
• Severability: If any provision is found invalid, the remaining provisions remain in effect.
• Assignment: You may not assign your rights without our written consent.
• Force Majeure: We are not liable for failures due to circumstances beyond our control.
• Waiver: No waiver of any provision shall be deemed a continuing waiver.
• Language: In case of conflict between English and translations, English prevails.
