Welcome to GetOnGlobal, an autonomous hiring platform that leverages artificial intelligence to connect employers with qualified candidates through intelligent screening, matching, and onboarding processes.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and GetOnGlobal Inc. ("GetOnGlobal," "we," "us," or "our") governing your access to and use of our platform, services, and related applications.

By accessing or using GetOnGlobal, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our platform.

2. Definitions

  • "Platform" refers to GetOnGlobal's website, mobile applications, APIs, and all related services and technologies.
  • "User" means any individual or entity that accesses or uses the Platform, including Candidates and Employers.
  • "Candidate" refers to individuals seeking employment opportunities through the Platform.
  • "Employer" means companies, organizations, or individuals posting job opportunities and seeking to hire candidates.
  • "AI Hiring Assistant" refers to our artificial intelligence systems that perform candidate screening, matching, assessment, and recommendation functions.
  • "Content" includes all text, data, information, software, graphics, and other materials available on or through the Platform.
  • "Services" encompasses all features, functionalities, and offerings provided through the Platform.

3. Eligibility and User Requirements

3.1 General Eligibility

  • You must be at least 16 years of age to use the Platform
  • You must have the legal capacity to enter into binding agreements
  • You must not be prohibited from using the Platform under applicable laws
  • You must provide accurate and complete information during registration

3.2 Candidate Requirements

  • Must be legally authorized to work in the jurisdictions where seeking employment
  • Must provide truthful and accurate information in profiles and applications
  • Must not create multiple accounts or misrepresent identity
  • Must comply with all applicable employment laws and regulations

3.3 Employer Requirements

  • Must be a legitimate business entity or authorized representative
  • Must have legal authority to hire employees or contractors
  • Must comply with all applicable employment, anti-discrimination, and labor laws
  • Must provide accurate job descriptions and company information
  • Must not post fraudulent, misleading, or illegal job opportunities

4. User Account Responsibilities

4.1 Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access or security breaches
  • You are liable for all activities that occur under your account
  • You must use strong passwords and enable two-factor authentication when available

4.2 Information Accuracy

  • All information provided must be current, complete, and accurate
  • You must promptly update your profile when information changes
  • False or misleading information may result in account suspension or termination
  • You grant us the right to verify the accuracy of provided information

4.3 Prohibited Activities

  • Using the Platform for any unlawful or fraudulent purposes
  • Attempting to circumvent or manipulate our AI systems
  • Harvesting or collecting user data without authorization
  • Interfering with the Platform's operation or security measures
  • Creating fake profiles or impersonating others
  • Posting spam, malicious content, or inappropriate material

5. Employer-Specific Responsibilities

5.1 Legal Compliance

  • Anti-Discrimination: Must comply with all applicable equal employment opportunity laws and regulations
  • Labor Laws: Must adhere to minimum wage, working hours, and other labor standards
  • Privacy Laws: Must handle candidate data in compliance with GDPR, CCPA, and other privacy regulations
  • Immigration Laws: Must verify work authorization and comply with visa requirements

5.2 Job Posting Standards

  • Job descriptions must be accurate, complete, and not misleading
  • Compensation information must be truthful and comply with pay transparency laws
  • Requirements must be job-related and non-discriminatory
  • Must not post positions that do not actually exist

5.3 Candidate Treatment

  • Must treat all candidates fairly and without discrimination
  • Must provide timely and professional communication
  • Must respect candidate privacy and confidentiality
  • Must provide feedback when requested and reasonably possible

6. AI-Based Decision Disclaimer

Important Notice: GetOnGlobal provides AI-powered tools and recommendations to assist in the hiring process, but does not make final hiring decisions.

6.1 AI Assistance Limitations

  • Our AI systems provide recommendations and insights, not final hiring decisions
  • Employers retain full responsibility for all hiring decisions and outcomes
  • AI assessments should be considered alongside human judgment and other factors
  • We do not guarantee the accuracy or completeness of AI-generated insights

6.2 No Employment Guarantees

  • We do not guarantee job placement for candidates
  • We do not guarantee successful hires for employers
  • Platform usage does not create an employment relationship with GetOnGlobal
  • All employment relationships are between employers and candidates directly

6.3 Bias and Fairness

  • We strive to minimize bias in our AI systems but cannot guarantee complete elimination
  • Users should be aware of potential algorithmic limitations and biases
  • Employers must ensure their hiring practices comply with anti-discrimination laws
  • We continuously work to improve fairness and accuracy of our AI systems

7. Fees and Subscriptions

7.1 Service Tiers

  • Free Tier: Basic access with limited features for candidates and small employers
  • Premium Subscriptions: Enhanced features, priority support, and advanced analytics
  • Enterprise Plans: Custom solutions with dedicated support and integration services

7.2 Payment Terms

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise specified
  • Prices may change with 30 days' notice to existing subscribers
  • Failed payments may result in service suspension or termination

7.3 Taxes and Additional Costs

  • Users are responsible for all applicable taxes and duties
  • Additional services may incur separate charges
  • Currency conversion fees may apply for international transactions

8. Cancellation and Termination

8.1 User-Initiated Termination

  • You may cancel your account at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds will be provided for unused portions of paid subscriptions
  • You may request data deletion in accordance with our Privacy Policy

8.2 GetOnGlobal-Initiated Termination

  • We may suspend or terminate accounts for violations of these Terms
  • We may terminate accounts for fraudulent or illegal activities

8.3 Effects of Termination

9. Intellectual Property Rights

  • Patents: Any patentable inventions developed by GetOnGlobal remain our property

9.2 User Content Rights

  • Candidate Content: Candidates retain ownership of their resumes, portfolios, and personal information
  • Employer Content: Employers retain ownership of job descriptions and company information
  • License Grant: Users grant GetOnGlobal a license to use their content for Platform operations
  • Content Responsibility: Users are responsible for ensuring they have rights to uploaded content

9.3 Restrictions

  • Users may not reverse engineer, decompile, or attempt to extract our algorithms
  • Users may not create derivative works based on our Platform
  • Users may not use our intellectual property without explicit permission
  • Users may not remove or modify any proprietary notices or labels

10. Limitation of Liability

IMPORTANT: Please read this section carefully as it limits GetOnGlobal's liability to you.

10.1 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETONGLOBAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

10.3 Liability Cap

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO GETONGLOBAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless GetOnGlobal, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Platform or violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Your violation of any applicable laws or regulations
  • Any content you submit, post, or transmit through the Platform
  • Your hiring decisions or employment practices (for Employers)
  • Any false or misleading information you provide

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

12.2 Dispute Resolution Process

  1. Informal Resolution: Before filing any formal dispute, you agree to contact us at legal@getonglobal.com to seek informal resolution
  2. Mediation: If informal resolution fails, disputes will be resolved through binding mediation
  3. Arbitration: Any remaining disputes will be resolved through binding arbitration under AAA rules

12.3 Jurisdiction and Venue

Any legal proceedings that cannot be resolved through arbitration shall be brought exclusively in the federal or state courts located in San Francisco County, California.

13. Updates to Terms and Conditions

13.1 Modification Rights

GetOnGlobal reserves the right to modify these Terms at any time. We will provide notice of material changes through:

  • Email notification to registered users
  • Prominent notice on the Platform
  • In-app notifications for mobile users
  • Updates to the "Last Updated" date at the top of these Terms

13.2 Acceptance of Changes

Continued use of the Platform after the effective date of any changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of the Platform.

13.3 Notice Period

Material changes will take effect 30 days after notice is provided, except for changes required by law, which may take effect immediately.

14. Miscellaneous Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and GetOnGlobal.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Assignment

You may not assign or transfer your rights under these Terms without our written consent. GetOnGlobal may assign these Terms without restriction.

14.4 Force Majeure

GetOnGlobal shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or government actions.
