This position is responsible for developing and implementing the Port’s labor compliance, payment of prevailing wages, and Project Labor Agreement activities. This includes decision-making responsibilities and accountability for the development of policies, procedures, goals and objectives, and standards to ensure compliance with payment of prevailing wages, apprenticeship standards, and the Port’s PLA*.* The work requires the use of industry related knowledge, skills, and abilities, initiative, good judgement, and discretion within broad guidelines. There is regular interactions with Port management, other public agencies, contractors and community organizations, regulatory agencies, and labor unions. Daily activities include communications, logging, tracking, updating, following up, auditing, relationship building, prioritizing, and organizing. A hybrid working option is a possibility for this position.
This position is a limited position with the expectation of becoming a permanent position in November 2026.
DEFINITION
Under general direction, manages, implements, and administers the Port’s Project Labor Agreement (PLA) which involves the identification and retention of skilled labor and employment and encourages small business participation, facilitates project cooperation between the Port and the union, and enforces payment of prevailing wages. Responsible for complying with Davis Bacon and Related Acts ("DBRA") and State Prevailing Wage ("SPW"), as applicable.

Receives general direction from assigned management personnel. Exercises direct supervision over professional, technical, and administrative staff.

Develop, implement, and maintain PLA compliance procedures.
Develop and/or maintain PLA forms required for monitoring contractor compliance with the PLA-defined goals/requirements.
Plans, directs, coordinates, administers, and supervises the activities of the Port’s PLA to ensure compliance with Articles 3 through 23 of the PLA.
Coordinate with divisions, departments, and Engineering-Construction management staff for kick-off at each project and establish logistics for Pre-Bid and Pre-Construction meetings.
Work with divisions and departments on Pre-Bid and Pre-Construction presentations on requirements.
Prepare the logistics and conduct PLA Pre-Job Conference.
Collect and review PLA forms from contractors including all lower-tier subcontractors and verify that work assignments are congruent with allowable crafts they are assigning work via the Pre-Job Conference process.
Monitor and enforce contractor compliance with the PLA’s Core Worker provisions of PLA Section 4.6 and verify contract’s Core Worker eligibility.
Monitor and enforce contractor compliance with trust fund payment to ensure compliance with PLA Article 6 (wages and benefits) and specifically payments made to the San Diego County Construction Trades Council Trust Funds.
Monitor and enforce contractor compliance with requests for union worker dispatch, worker utilization, and goal attainment.
Review weekly certified payroll records and apprenticeship documents to ensure complete submittals and compliance with Articles 6 through 14 of the PLA.
Collect Letters of Assent for all identified contractors and distribute to the appropriate unions.
Issue monthly compliance notifications to contractors to apprise them of their compliance with the PLA and their PLA-defined worker attainment levels.
Assist with conducting site inspections and worker interviews.
Contact developer, prime contractors and subcontractors to secure payroll and related records and respond to inquiries.
Ensure contractors comply with contractor-defined work assignments.
Work with the General Contractors and/or assigned PLA project's Construction Manager to ensure PLA work assignments are complete for all identified PLA project contractors.
Provide PLA compliance advisory notices and make recommendations regarding enforcement measures to ensure the contractor’s compliance with the general conditions of the contract and the PLA.
Work with unions, apprenticeship programs and community-based organizations (CBO’s) to ensure the appropriate and maximum utilization of local workers.
Administration and utilization of compliance management software to assist with PLA compliance, which includes reviews of prevailing wage laws for both State and Federal requirements (when required).
Maintain files and electronic databases related to contractor’s compliance with apprenticeship laws, and workforce compliance.
Maintain the following databases: work assignment management; Pre-Job Conference meetings; dispute/grievance management; compliance tracking logs per job; workforce utilization, trust fund audit logs.
Use database statistics for compliance reporting.
Recommend compliance management software selection, edits, and administration.
Utilize compliance management software database/reports.
Prepare quarterly compliance status reports summarizing PLA goal attainment amongst PLA-applicable projects.
Develop and implement a Community Outreach Plan and interface with divisions departments and unions to facilitate workforce outreach efforts that assist contractors in meeting the PLA’s local, disadvantaged, and veteran workforce outreach and hiring goals.
Establish a Community Based Organization collaborative that meets regularly to ensure CBOs are referring viable candidates to the contractors and union’s apprenticeship training programs.
Manage grievance/arbitration logistics and serve as the Port’s representative at grievance/arbitration meetings.
Assist workers and contractors with work jurisdictional issues and PLA grievances.
Work with contractors who are delinquent in prevailing wage and trust fund payments.
Respond to public records requests as they relate to labor compliance and payment of prevailing wages.
Assisting in responding to inquiries and requests for records from the Department of Labor and Civil Wage and Penalty Assessments from the Department of Industrial Relations (DIR).
Gather records for investigations of alleged Davis-Bacon and Related Acts (DBRA) and SPW violations and report results to Port management.
Communicate concerns regarding non-compliance/non-submittal issues and possible PLA violations to contractors and Port management as applicable.
May be assigned disaster service worker responsibilities as directed.
Performs related duties as assigned.

Education and Experience:

Education:
Equivalent to a bachelor’s degree from an accredited college or university with major coursework in business administration, public administration, or a related field.
Experience:
Four (4) years of increasingly responsible experience in labor compliance, contract compliance, or construction management.
Licenses and Certifications:
Hiring Range Negotiable Between: $111,555 - $136,938 DOQ/DOE*

PHYSICAL DEMANDS
Must possess mobility to work in a standard office setting and use standard office equipment, including a computer; to operate a motor vehicle and visit various Port sites; vision to read printed materials and a computer screen; and hearing and speech to communicate in person and over the telephone. This is primarily a sedentary office classification although standing in work areas and walking between work areas may be required. Finger dexterity is needed to access, enter, and retrieve data using a computer keyboard or calculator and to operate standard office equipment. Positions in this classification occasionally bend, stoop, kneel, reach, push, and pull drawers open and closed to retrieve and file information. Employees must possess the ability to lift, carry, push, and pull materials and objects up to 10 pounds.
ENVIRONMENTAL CONDITIONS
Employees work in an office environment with moderate noise levels, controlled temperature conditions, and no direct exposure to hazardous physical substances. Employees may interact with upset staff and/or public and private representatives in interpreting and enforcing divisional policies and procedures.
